Lawyers are on most lenders’ preferred professional lists. Hold a current practising certificate and earn above the lender’s income threshold, commonly around $150,000 per year, and a number of lenders will lend up to 90% of the property’s value with the LMI premium waived entirely, subject to lender assessment. This page covers employed solicitors, barristers and in-house counsel. If you are an equity or salaried partner, the law firm partners page deals with draws, distributions and buy-ins in detail.
| Maximum LVR without LMI | Typically 90%, subject to lender assessment |
| Who qualifies | Solicitors and barristers with a current practising certificate; in-house counsel with some lenders |
| Common income threshold | Often around $150,000 p.a.; varies by lender, some assess household income |
| Documents usually requested | Practising certificate, professional body membership, payslips or tax returns, ID, statements |
| Typical approval timeline | Around 1-3 weeks for PAYG solicitors; longer for self-employed barristers |
Do Lawyers Pay LMI in Australia in 2026?
In most cases, no, not up to 90% LVR. A number of lenders waive lenders mortgage insurance for legal professionals who hold a current practising certificate and meet a minimum income requirement, typically around $150,000 per year, subject to lender assessment.
LMI normally applies whenever you borrow more than 80% of a property’s value, and the premium scales up sharply with both the loan size and the LVR. Lenders waive it for lawyers because the profession combines stable employment, strong income growth and low historical default rates. The practical effect is that a solicitor with a 10% deposit is treated the way other borrowers are treated with a 20% deposit.
Waiver policies are not published consistently and they change. Part of our job, and our obligation under the Best Interests Duty, is comparing the professional packages actually available to you rather than defaulting to any one lender.
Two lenders can both waive LMI for a solicitor and still be thousands of dollars apart on rate and fees over five years. I compare the professional packages side by side, because a waiver attached to an uncompetitive rate is not a saving, it is a headline.
Which Legal Professionals Qualify for an LMI Waiver in 2026?
Most lenders’ legal professional policies cover solicitors and barristers holding a current Australian practising certificate, with some extending to in-house counsel and judicial officers.
- Solicitors: a current practising certificate plus, with some lenders, law society membership.
- Barristers: admission to the bar and a current certificate; income is assessed as self-employed.
- In-house counsel: accepted by a number of lenders where a practising certificate is held.
- Judicial officers and some tribunal members: accepted by some lenders.
- Generally not eligible for the waiver: paralegals, law clerks, conveyancers and legal secretaries, although standard lending at up to 95% LVR with LMI payable remains available.
Eligibility lists differ between lenders, so a declined waiver with one lender does not mean a declined waiver everywhere.
How Much Can a Lawyer Borrow Without LMI in 2026?
Typically up to 90% of the property’s value, subject to lender assessment. Your overall borrowing power still depends on income, existing debts and living expenses; our borrowing power calculator gives a quick first estimate.
Here is what the waiver is worth on a realistic Sydney purchase:
- Purchase price (Sydney unit): $1,100,000
- Deposit at 10%: $110,000, plus stamp duty and costs
- Loan amount: $990,000 (90% LVR)
- LMI that would normally apply at 90% LVR: commonly in the range of $20,000 to $30,000
- LMI payable with a legal professional waiver: $0

How Do Lenders Treat Barristers’ Income in 2026?
As self-employed income, in almost every case. Barristers practise as sole practitioners, so lenders generally ask for one to two years of personal tax returns and notices of assessment rather than payslips.
Chambers rent, clerk fees and the famously lumpy timing of fee income all affect how a lender reads your figures. Some lenders average two years of income, others use the most recent year, and a few will consider alt doc verification where your latest return is not finalised. Newer barristers coming off a strong employed income can be the trickiest cases, and the lender choice matters far more than the rate sheet suggests. Our self-employed lending page covers the documentation options in depth.
Can In-House Counsel Get the Legal Professional LMI Waiver in 2026?
Often, yes. A number of lenders extend the waiver to in-house counsel who hold a current practising certificate, while some restrict their policy to private practice.
The upside for in-house lawyers is simple documentation: payslips and an employment contract, the same as any PAYG applicant. If a meaningful share of your package is bonus or equity, lenders typically count only part of it, which is the same challenge senior executives face; our senior executives page explains how bonus income is shaded.
What Documents Do Lawyers Need for a Home Loan in 2026?
For employed solicitors and in-house counsel, the list is short; barristers add self-employed verification.
- Photo ID and a current practising certificate
- Evidence of law society or bar association membership, where the lender requires it
- Employed: two recent payslips and, with some lenders, an employment contract or latest group certificate
- Barristers: one to two years of personal tax returns and notices of assessment
- Bank statements showing savings and conduct on existing debts
With documents ready, pre-approval for a PAYG solicitor is often possible within about a week. Accountants enjoy a near-identical waiver; if your household includes one, see home loans for accountants, and the full list of eligible professions is on our professional LMI waiver hub.
